yay.gift terms of service
1. Service provider
yay.gift is provided by Seatarena Sp. z o.o., ul. Świętokrzyska 12/305-307, 30-015 Kraków, Poland, KRS 0001189117, NIP 6772529318.
2. The service
yay.gift helps a group organize shared gifts: a draw of who buys a gift for whom (Secret Spin) and a Wishlist with reservations and group gifts. It works in the browser and in the mobile app. Draw fees are described in section 5.
3. Account and participants
- Organizers sign up with an email address confirmed by a one-time code.
- An organizer who enters other people's data (name, contact) confirms they may share it and informs those people. Each of them can opt out.
- Participants join with a link and a one-time code or with a personal link. Personal links shouldn't be shared.
4. Rules of use
- yay.gift must not be used for spam, impersonation or unlawful content.
- Only the person who drew knows their result. The organizer can reveal matches with the consent of most participants, as described in the app.
- Riddles are created by an AI model. They may miss - it's a game, not advice.
5. Draw fees
- The Wishlist is free. In Secret Spin, the first draws on the organizer's account are free and the next ones are paid according to the number of people at the moment of starting. The current price list is on the home page ("How much does it cost?") and in the organizer's panel before starting. Prices are in Polish zloty (PLN).
- The organizer pays when starting the draw through a payment gateway: Stripe (card, BLIK, Przelewy24) or ING Bank Śląski (imoje). The draw starts once the gateway confirms the payment, and the organizer gets a confirmation by e-mail.
- Pausing and resuming a draw doesn't require paying again. If more people joined during the pause and the price went up, the difference is paid when resuming.
- A draw is a digital service performed right after payment. Before paying, the organizer agrees to the service starting before the 14-day withdrawal period ends and acknowledges losing the right of withdrawal once the draw starts.
- If the payment fails or is cancelled, the draw doesn't start and nothing is charged.
6. Payments between participants
For group gifts, yay.gift doesn't receive or transfer money - participants pay the person buying the gift directly by bank transfer or BLIK. Participants are responsible for settling up.
7. Complaints
Complaints can be sent by post to the provider's address. We reply within 14 days.
8. Personal data
Data processing and cookies are described in the privacy policy and the cookie policy.
9. Changes
We announce changes to these terms on this page at least 14 days in advance. Polish law applies; this doesn't limit consumer rights under the laws of the consumer's country.
